Latitude Financial Services Privacy Breach Investigation

Dear Registrant,

 

Thank you for your ongoing interest in Gordon Legal and Hayden Stephens & Associates’ Latitude Financial Services privacy breach investigation.

 

We’re getting in touch to provide you an update to about the case.

Current group claims

 

We have previously filed representative complaints against Latitude with:

  • the Australian Privacy Commissioner (Privacy Commissioner); and
  • the New Zealand Privacy Commissioner (NZOPC).

On 17 December 2023, the Privacy Commissioner wrote to Gordon Legal to provide its preliminary view that the complaint was valid.

 

On 14 May 2024, Gordon Legal received confirmation from the Privacy Commissioner that the complaint was validly made. On 29 April 2024, the NZOPC notified Gordon Legal that it has been working with the Privacy Commissioner in a joint investigation.

Privacy Commissioners’ investigations

 

The joint investigation remains ongoing. This is quite common for privacy investigations – especially for matters of such a significant scale, where the breach has affected millions of potential customers.

For example, the Australian Privacy Commissioner recently handed down a decision in an investigation against Kmart Australia Limited. The Commissioner commenced that investigation in July 2022, and a final decision was delivered in August 2025. That constituted a period of almost three years from the beginning of the investigation to final decision.

Considering the scale of the Latitude privacy breach, we anticipate that the current investigation will, unfortunately, take a similar amount of time.

Class action investigation

 

We are well advanced in our preparatory work to file a class action on behalf of affected Latitude customers.

We will be able to provide registrants with a more substantive update at the end of July.
